| TERMS & CONDITIONS OF SALE | |
| 1. On the fall of the auctioneer's hammer, the highest bidder shall be deemed to have purchased the offered lot in accordance with all of the conditions set forth herein and, thereupon will pay the purchase price in full. Payment terms are cash, approved check, Visa or Mastercard. All accounts must be paid the day of sale and before leaving the premises. Absentee bidders must make full payment within 24 hours, otherwise Auctioneer may resell merchandise at public or private sale. No purchases shall be removed until payment is received in full. Auctioneer may, at his discretion, hold purchases until check clears. 2. State and local sales taxes are applied to all purchases unless a valid resale number is on file. 3. Bidders are required to register and give full identification. Bidders must use a bid card to acknowledge a purchase. As each item is sold the Auctioneer will announce the bid price and buyer's bid card number. Failure to immediately object constitutes acknowledgment of the purchase at the announced price. Bidders must use their own number. 4. Removal shall be at the expense, liability and risk of the purchaser. All items must be removed day of sale unless previous arrangements are made with the Auctioneer. Auctioneer will not be responsible for goods not removed within the time specified, and shall have the option of removing and storing at the expense and risk of the buyer any article purchased in which case Auctioneer may resell without notice at public or private sale, or dispose of at the expense of the seller. All items sold AS IS, WHERE IS. ALL SALES FINAL. 5. Though all description and commentary are believed to be correct, neither Auctioneer nor Consignor make any warranties or representations of any kind with respect to merchandise. Buyer shall not rely on the Auctioneer, employees, the catalog description, or advertisements in any part and must rely only on his own inspection and opinions of all items. 6. The Auctioneer is acting as agent only and is not responsible for acts of its principals. If any dispute arises, the Auctioneer's word is final. 7. If a lot is offered subject to reserve (the confidential minimum price below which a lot will not be sold), we may implement such a reserve by bidding on behalf of the consignor. 8. The Auctioneer reserves the right to reject a bid from any bidder. The highest bidder acknowledged by the auctioneer shall be the purchaser. In the event of any dispute between bidders, or in the event the auctioneer doubts the validity of any bid, the auctioneer shall have sole and final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after the sale, our sales records shall be inclusive in all respects. 9. Absentee bids will be accepted. Food For Thought is not responsible for bids that are missed or otherwise not executed. IMPORTANT NOTE: ABSENTEE BIDS will be accepted from Tuesday August 10, 2010 at noon until Friday August 13 at 5pm. 10. All statements contained in the catalogue or in any bill of sale, invoice or elsewhere as to authorship, period, source, origin, measurement or condition are qualified statements and shall not be deemed to be representations or warranties. 11. Small items can generally be picked up all day at the smalls window. Larger items may have to wait until later (usually 3pm), when we have staff available to assist with check-out. Food For Thought and its employees shall not be held liable for any damages or accidents that may result from handling, lifting, moving, loading and packing of purchases. Buyers may bring their own help. On some items (i.e. pianos), Auctioneer may refuse his assistance and/or require buyer to hire a professional mover at buyer's expense. In the case of fragile items the Auctioneer may require buyer to handle removal without assistance. 12. ALL PROPERTY IS SOLD "AS IS" AND NEITHER WE NOR THE CONSIGNOR MAKES ANY REPRESENTATION OR WARRANTY, EXPRESSED OR IMPLIED, AS TO THE MERCHANTABILITY, FITNESS OR CONDITION OF THE PROPERTY OR AS TO THE CORRECTNESS OF DESCRIPTION, GENUINENESS, ATTRIBUTION, PROVENANCE OR PERIOD OF THE PROPERTY. 13. ESTIMATED PRICES - As a convenience to our clients, we furnish pre-sale estimates for all materials included in the auctions. These estimates are only our approximate valuations and should be taken as educated guesses based upon comparable auction values, not as "prices." Bidding normally begins at about one-half the low estimate, but the final bid price may well be less than or more than any estimate printed. 14. Condition of property: As a service to prospective purchasers, we may note the physical condition of certain lots included in this catalogue. However, the fact that damages, repairs, restorations or other defects are described for certain lots, does not mean that all defects to such lots are described or that similar conditions do not exist with respect to other lots although not noted. Such descriptions are not intended to negate the conditions of sale included in this catalogue. We urge prospective purchasers to inspect property prior to bidding.
